These Terms of Service ("Terms") govern your access to and use of the CaffCup website, products, subscriptions, and related services (collectively, the "Services").

CaffCup is a brand operated by S&N Enterprises, a partnership firm having its registered office at S-5/701 Near Shiv Auto Works, Opp Shah Colony, Saili Kullian, Sailli, Pathankot, Punjab 145001.

Throughout these Terms, the words "CaffCup", "we", "us", and "our" refer to S&N Enterprises operating under the CaffCup brand.

By accessing our website, creating an account, subscribing to our services, placing an order, or otherwise using our Services, you agree to be bound by these Terms, our Privacy Policy, Shipping Policy, Replacement Policy, and any other policies published on the website.

1. ELIGIBILITY

We reserve the right to refuse service, suspend accounts, or cancel orders at our sole discretion.

You are solely responsible for all activities occurring under your account.

CaffCup reserves the right to suspend or terminate accounts suspected of fraud, abuse, misuse, or violation of these Terms.

6. ORDERS

All orders placed through CaffCup are subject to acceptance and availability.

We reserve the right to:

Cancel orders

Restrict quantities

Refuse service

Verify customer information

Orders suspected of fraud, abuse, unauthorized resale, or unlawful activity may be cancelled without notice.

7. PRICING AND PAYMENT

All prices displayed on CaffCup are in Indian Rupees (INR) unless otherwise specified.

Payments may be processed through third-party payment providers.

CaffCup does not store complete card information.

We reserve the right to correct pricing errors, product information errors, or system errors at any time.

If a pricing error occurs, we may cancel the affected order and issue a refund.

8. SHIPPING

Currently, CaffCup ships only within India.

Delivery timelines are estimates and not guarantees.

Delays may occur due to:

Courier issues

Weather conditions

Public holidays

Government restrictions

Force majeure events

Operational disruptions

CaffCup shall not be liable for reasonable shipping delays beyond its control.

9. REPLACEMENT POLICY

Due to the consumable nature of coffee products, CaffCup does not accept returns.

Replacements may be offered solely for products received damaged during transit.

To qualify:

Damage must be reported within 48 hours of delivery.

An uninterrupted unboxing video must be provided.

Clear photographs of the outer package and damaged product must be provided.

Failure to provide adequate proof may result in rejection of the replacement request.

Replacement decisions shall be made at CaffCup's sole discretion.

10. REFUND POLICY

Refunds may be issued only in limited circumstances, including:

Orders confirmed lost in transit by the courier.

Orders cancelled by CaffCup before shipment.

Duplicate payment processing errors.

Refunds shall not be granted where:

Incorrect delivery information was provided.

The customer refuses delivery.

Delivery attempts fail due to customer unavailability.

The customer changes their mind after shipment.

The customer dislikes the taste, aroma, or personal experience of the product.

11. SUBSCRIPTIONS

Where subscription services are offered:

Subscription plans renew automatically unless cancelled.

Customers will receive advance notification before renewal where technically feasible.

Customers may cancel before the next billing cycle.

Cancellation affects future renewals only.

Charges already processed are non-refundable.

CaffCup may modify subscription pricing, benefits, or frequency upon reasonable notice.

We do not guarantee specific outcomes, performance improvements, productivity gains, focus improvements, or any individual results.

16. LIMITATION OF LIABILITY

CaffCup, S&N Enterprises, its partners, employees, contractors, suppliers, manufacturers, affiliates, and service providers shall not be liable for:

Consequential damages

Incidental damages

Punitive damages

Loss of profits

In all circumstances, the total liability of CaffCup arising from any claim shall not exceed the amount actually paid by the customer for the specific order giving rise to the claim.

17. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless CaffCup, S&N Enterprises, its partners, employees, contractors, suppliers, and affiliates from any claims, damages, losses, liabilities, costs, or expenses arising from:

Your breach of these Terms

Your misuse of the Services

Your violation of any law

Your infringement of third-party rights

18. FORCE MAJEURE

CaffCup shall not be liable for delays, interruptions, or failures resulting from circumstances beyond reasonable control, including:

Natural disasters

Floods

Fires

Pandemics

Government actions

Strikes

Internet outages

Transportation disruptions

Supply chain interruptions

19. TERMINATION

We may suspend or terminate access to the Services at any time without notice if we believe you have violated these Terms or applicable law.

20. SEVERABILITY

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

21. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of India.

22. DISPUTE RESOLUTION AND ARBITRATION

Any dispute arising out of or relating to these Terms, the Services, or any transaction with CaffCup shall first be attempted to be resolved amicably.

If resolution is not achieved, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.

Language: English

Number of Arbitrators: One

The arbitration award shall be final and binding.

Subject to the arbitration provisions above, the courts located in Pathankot, Punjab shall have exclusive jurisdiction.

23. CHANGES TO THESE TERMS

CaffCup may modify these Terms at any time.

Updated Terms will be posted on this page.

Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
